Terms of Service

GENERAL

I WILL REPLY WITHIN 48 HOURS TO DISCUSS DETAILS BEFORE SENDING AN INVOICE. I will start only after receiving references and receiving payment.

I have the right to reject any order that I do not feel comfortable drawing for any reason.

PAYMENTS

All prices listed are in USD. I only accept payment upfront via Paypal invoice or VGen. Direct e-transfers are also accepted for CAD payments. Half payments or payments in increments can be discussed.

I may include additional fees for commercial use.

REVISIONS

Simple revisions included. You may request to see sketches and WIPs in advance, but changes will cost extra after the coloured image is sent.

DEADLINES AND DELIVERY

Typically 1-4 weeks, depending on your spot in my queue and the complexity of the piece. You may ask about your spot in my queue and tentative delivery date based on my estimations at the time.

USE

Personal use only. Client may use artwork for social media icons, banners and assets. Client may repost a watermarked version with credit given. If interested in Commercial Use such as streaming, please state so in your request and pricing can be discussed.

The buyer is allowed to:

  • Use the commissioned piece for personal use unless agreed otherwise (you can upload it on all your social media profiles, discord, etc.)
  • Print the artwork and claim the character(s) as their own, but not the artwork itself.
  • Use the artwork to promote themselves. Please include credit towards me (Samuraiflame or Saeryn).

INTELLECTUAL PROPERTY RIGHTS

Ownership of Artwork. I retain all ownership rights to the Artwork as an artistic work, including marketing, copyright and exhibition rights.

I, Samuraiflame (the artist), claim the rights to the produced drawing, not the buyer. Therefore I am allowed to use the copyrighted artwork to: 

  • Promote myself with it everywhere
  • Publish books with it (artbooks, etc.)
  • Display it everywhere to my liking (website, social media, etc.)
  • Post it wherever I want
  • The above actions will not be done if the commissioner/buyer explicitly requests it

REFUNDS

Please reach out if you seek a refund. Commissions cannot be refunded after I have started work on the commission. If you wish to cancel a commission, please discuss with me about a partial refund for any work not completed.

COMMUNICATION

If delays arise, I will do my best to communicate that.
